Terms of Legal Assistance

This document defines the general terms of interaction between advocate Oleksandr Vadymovych Hezerdava and persons seeking legal assistance through the website (the “Site”). It is not a public offer within the meaning of Articles 633 and 641 of the Civil Code of Ukraine.

Information published on the Site is for informational purposes only and does not constitute an offer to an unlimited number of persons to enter into an agreement for the provision of legal assistance.

An agreement for the provision of legal assistance is concluded exclusively in writing between the advocate and the client in accordance with the Law of Ukraine “On the Bar and Advocacy”.

2. Procedure for seeking legal assistance

Legal assistance is sought in the following order:

  1. the person contacts the advocate via the contact form, telephone, or email;
  2. the advocate reviews the enquiry and determines whether the engagement can be accepted;
  3. the scope of legal assistance, terms, and fee are agreed;
  4. an agreement for the provision of legal assistance is concluded.

3. Cost of legal assistance

The cost of legal assistance (the advocate’s fee) is determined by agreement between the parties, taking into account the complexity of the matter, scope of work, deadlines, and other material circumstances.

Information about possible service costs published on the Site is indicative and is not binding on the parties.

4. Rights and obligations of the parties

The advocate has the right to:

  • refuse to accept an engagement in cases provided by law;
  • receive a fee in the manner and amount specified in the agreement;
  • independently determine the legal position within the limits of the law and the agreement.

The client has the right to:

  • receive legal assistance of appropriate quality;
  • receive information on the progress of the engagement;
  • terminate the agreement in the manner provided by law and the agreement.

5. Confidentiality and attorney–client privilege

All information received by the advocate from the client or in connection with the provision of legal assistance constitutes attorney–client privilege under Article 22 of the Law of Ukraine “On the Bar and Advocacy”.

6. Limitation of liability

The advocate is not liable for consequences arising from the use of information from the Site without concluding an agreement for the provision of legal assistance.

7. Applicable law

These terms are governed by and construed in accordance with the legislation of Ukraine.
