Housing and Utility Law

Housing and Utility Law

Protection of the rights of residents, property owners, and tenants in disputes with neighbors, property management companies, Homeowners Associations (HOAs), and public utilities. Water damage/flooding, eviction, unlawful utility rates, and residential registration. The initial consultation is free of charge.

Housing disputes are among the most emotionally and financially challenging. Neighbors cause water damage, yet no one volunteers to compensate for the losses. A property management company raises utility rates without any legal grounds. An HOA claims non-existent debts. An owner faces eviction threats, or a family member is about to be stripped of their registered place of residence. Each of these situations requires a precise understanding of the law and timely action.

I represent the interests of residents, apartment owners, and tenants in relations with neighbors, HOAs, property management companies, public utilities, and government authorities. A specialized area of my practice focuses on disputes regarding the quality and cost of housing and communal services: challenging unlawfully accrued debts, contesting inflated tariffs, and protecting the right to housing subsidies.

The legal framework of this practice area is established by the Housing Code of the Ukrainian SSR (as amended), the Civil Code of Ukraine, the Law of Ukraine "On Housing and Communal Services" No. 2189-VIII, the Law of Ukraine "On Associations of Co-owners of Multi-Apartment Buildings" No. 2866-III, as well as the current jurisprudence of the Supreme Court regarding evictions, disputes with HOAs, and liability for water damage. Most housing conflicts can be resolved out of court—provided that a formal claim is drafted correctly and one's legal rights are fully understood.
