Inheritance is one of the most common reasons for seeking legal counsel. Martial law has significantly altered inheritance law. On January 30, 2024, new rules for opening succession during martial law entered into force. The issue of property located in temporarily occupied territories has been regulated separately: if the property is intact, one can only open an inheritance file, but obtaining a certificate of inheritance is impossible — if the property is destroyed, the notary has no legal grounds to issue a certificate of inheritance. The estate of a missing service member is subject to a special legal regime: starting February 1, 2025, relatives of military personnel who were receiving allowances (the missing soldier’s military pay) will receive only 50% of the previous amount. The remaining 50% will be deposited into the military unit's account until the soldier reappears or is officially declared deceased, after which the deposited amount is either paid to the soldier or included in the estate.
